Terms of Service

By using DerCraft Servers products and services, you agree and will comply with all of our policies. We have the right to cancel, suspend, or terminate any service or product provided with or without a refund or notice or warning for any reason. We also reserve the right to change and Modify our Terms of Service at any time without client notification. It is up to the client to periodically check with the recent Terms of Service. If any client does not comply with the new Terms of Service modifications, his or her service will be terminated.

We do not take responsibility for any content made and/or uploaded by the vendors on this website, we do however supply community support and paid product support on our Discord should there ever be any issues.

The purchase service is only available to people who have turned 13 years of age, and with the agreement of a legal guardian in the case if you are underage in your country.

The vendor service is only available to people with a valid Stripe or PayPal account. "Client", "Users", "You" and "Your" refers to you, the person accessing this website and accepting the Company terms and conditions. "The Company", " Ourselves", "We" and "Us", refers to our Company DerCraft Servers.

Payment, Refunds, and Cancellations

It is the buyer's responsibility to pay before the payment is due, failure to do that will result in the service suspension, and then termination. If the buyer wants his service unsuspended because the buyer failed to pay in time, there will be late fees added to their invoice. We have the right to suspend or terminate at any time after your service is overdue, if your server gets terminated we are not obligated to retrieve your data.

We only provide refunds within 24 hours. Payment using our Payment Processors might incur fees when refunding in full. We have the right to deny refunds for any reason even if it's within the 24-hour period. We strictly do not give out refunds for our dedicated servers and reseller plans. We could only refund the buyer in website credit, if DerCraft Servers agrees to such, we are not obligated to give the buyer any refunds at any time. Any Promotional offers are not eligible for a refund. Also, if the buyer forgets to disable his subscription, DerCraft Servers will not refund him under any means; it is not our responsibility that the buyer did not turn off their subscription even after the cancellation.

The Client is responsible for canceling any recurring payment subscriptions for Our Services that they have set up with the PayPal or other payment providers upon service termination.

Disputes

Any payment chargeback or charges will result in the termination of your service with us. Any legal threats will also result in the immediate termination of your services(s) with us.

Support

All of our support is unmanaged. We only provide you with the essentials needed to get full access to your service. We provide basic knowledge of hosting and we may be able to assist you in questions you may have. We will however provide support for any issues regarding hardware, control panels. Also, we will not provide support of any kind to servers containing cracked plugins or illegal files.

SLA

At DerCraft Servers we guarantee the network uptime of 99.9%, In the unlikely event that the service is inaccessible by the client, The client may open a ticket to be compensated by our support team depending on the service downtime duration. We will look into the situation and investigate the circumstances of the downtime. We are not held responsible for any unplanned outages due to third-party software or hardware failures.

Backups

We provide off-site backups for all services for a monthly subscription. Each server is backed up every 12 hours and is kept on our off-site server which is not accessible directly by the client. If you require a backup to be restored or to be in a separate folder in your server files you may request it in the billing panel or by tickets on our discord server. This service might incur a fee for services without the backup subscription. If your server has been terminated within the past 14 days we might have a backup available for a 5$ fee. DerCraft Servers is not liable for any loss of backups/files.

Acceptance Use Policy

CPU cores are shared in shared hosting. We give and allow a certain amount of virtual cores to each server which is listed when ordering. If you are using 100% of the cores for an extended period of time we will ask the client to reduce their usage. Failure to reduce their usage after being asked will result in the immediate termination of account and services without a refund. We also offer more virtual cores as a paid addon which can use their cores at 100% with a prolonged amount of time. Clients using shared website hosting are not allowed to run or publish any games on the website node, failure to follow this will result in the immediate termination of your service.

Forbidden Activity

We do not tolerate Denial of Service attacks, Port scanning, Botnets, TOR exit nodes, Proxies, Open DNS resolver, illegal downloads, Virtual currency mining, Crawlers, IP spoofing, Phishing, Ram Hacks, Stresser Website and Adult materials.

Purchases

You agree that you will pay for all products through our service, and that we may charge your payment method for any products or services purchased from us through the Service. Prices for products and services offered by us or vendors via the Service may change at any time, and the Service does not provide price protection or refunds in the event of a price reduction or promotional offering. Any purchase made from dercraft.net via the Service is non-refundable. Purchases of assets from DerCraft gives you license to use commercially in-game. You are prohibited from redistributing the resource unless given permission. If your account is suspended or terminated due to your breach of the terms, you will not be refunded for any purchase made from dercraft.net.

General DerCraft License

When purchasing a product listed on the DerCraft marketplace, you are purchasing a license to the Intellectual property of the vendor.

The license allows you to:

Use the assets for personal use
Use the assets for the purpose of selling as a cosmetic incentive on the platform you operate. This could include, but is not limited to in-game cosmetics, forum badges, Discord emotes and TeamSpeak icons.
Use imagery you create with the product to advertise the above.
Use the assets to create entertainment – such as videos or live streams.

The License does not allow you to:

Share the source files with individuals who do not hold a license.
Re-sell the assets; whether they are bundled with other files or not.
Modify the content of the files in order to sell.
Claim the assets as your own (you cannot claim that you created the assets for example).
Use the assets for the production or distribution of non-fungible tokens (commonly known as an NFT).
This license is not static and can be updated at any time without notice and retrospectively apply to any purchase made before the update.

Reviews & Support

You are not allowed to use reviews to ask for or push for support. If you want product support, or more features in a product, you have to join our Discord server as stated multiple times in the purchase process. Using reviews to complain about a lack of features or to suggest features is also not allowed. The product page states what the purchase comes with before you check out.

Reviews have to include a written review of why you give it the score you give it, it cannot simply be an empty review with a score or give no context.

Disclaimers

DerCraft has no obligation to screen or monitor any content and does not guarantee that any content available on the Service complies with the TOS of the desired platform you intend to make use of it with.

DerCraft provides the Service on an “as is” basis. You therefore use the Service at your own risk. DerCraft expressly disclaims any and all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any other warranty that might arise under any law. Without limiting the foregoing, DerCraft make no representations or warranties: (i) Concerning any content submitted by any user; (ii) Concerning any third party’s use of content that you submit to the Service; (iii) That any content you submit to the Service will be made available on the Service or will be stored by DerCraft; (iv) That the Service will be permitted in your jurisdiction; (v) That the Service will be uninterrupted or error-free; (vi) That the Service will meet your business or professional needs; (vii) That DerCraft will continue to support any particular feature of the Service; or (viii) Concerning sites and resources outside of the Service, even if linked to from or within the Service.

To the extent any disclaimer or limitation of liability does not apply, all applicable express, implied, and statutory warranties will be limited in duration to a period of ninety (90) days after the date on which you first used the Service, and no warranties shall apply after such period.

Limitations of liability

To the fullest extent permitted by law: (i) DerCraft shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses; and (ii) DerCraft total liability to you shall not exceed the amounts paid by you to DerCraft over the one (1) year period preceding your claim(s).

Redistribution

You are not allowed to redistribute any files downloaded from our marketplace.

Our products are model based and can be used in many ways, one of them is being put into a Minecraft resource pack or servers. Other ways could include animations, plugins, general videos and other seamlessly endless things.

The most common use of our models are for Minecraft resource packs, therefore we package them and use language to make it easy for our customers, this does not mean the products are made specifically for use in the game Minecraft.

This means that our products are not covered or touched by the Minecraft EULA nor terms and we will take legal action against any piracy or asset sharing done by the end user.

The products sold on this website are covered as Intellectual Property, therefore automatically have copyright protections. By buying a product, you are buying a license to that Intellectual Property – which can be revoked at any time.

Important Note

All files on users services are users responsibility. DerCraft Servers holds no responsibility for what our client uploads. We do not allow any forms of copyright violation and will result in immediate suspension.
